This Policy applies to information we collect through: (a) the Site and any subdomains; (b) email, phone, video calls, or messaging platforms used to correspond with us; (c) proposals, statements of work, and project delivery activities; and (d) events, webinars, or marketing communications we run. It does not apply to third-party websites, applications, or services we do not own or control.

3. Information We Collect

3.1 Information you provide

3.2 Information collected automatically

When you visit the Site, we and our infrastructure providers may automatically collect device and usage information, such as IP address, browser type, operating system, referring URLs, pages viewed, timestamps, and general geolocation inferred from IP. We use privacy-respecting analytics where possible and keep this data limited to what is necessary to operate and secure the Site.

3.3 Cookies and similar technologies

The Site uses a limited set of first-party cookies and similar technologies for essential functionality (session integrity, security, load balancing) and, where applicable, aggregated analytics. You can control cookies through your browser settings; disabling essential cookies may affect Site functionality.

3.4 Client and end-user data during engagements

In the course of delivering Services, clients may grant us access to systems that contain data about their own users, customers, or employees. We process such data solely as a service provider or processor on behalf of the client, under the terms of the applicable engagement agreement or data processing addendum ("DPA"). We do not use client data for our own marketing or to train third-party AI models.

4. How We Use Information

We use the information we collect to:

  • operate, secure, monitor, and improve the Site and our internal systems;
  • comply with legal, tax, accounting, and regulatory obligations;
  • send transactional communications (project updates, invoices, renewals) and, with your consent where required, marketing communications about relevant offerings;
  • detect, prevent, and investigate fraud, abuse, or security incidents; and
  • exercise or defend legal rights and enforce our agreements.

5. Legal Bases for Processing

Where the EU/UK GDPR applies, we rely on: (a) your consent for optional communications and non-essential cookies; (b) the performance of a contract when we deliver Services or respond to pre-contractual requests; (c) our legitimate interests in operating and marketing our business, securing our systems, and improving our Services; and (d) compliance with legal obligations.

6. How We Share Information

We do not sell personal information. We share information only as necessary and with appropriate safeguards:

  • Service providers / subprocessors: cloud hosting, email, communications, analytics, CRM, billing, and similar vendors that process information on our behalf under written agreements.
  • Clients: when you contact us on behalf of a company, we may share your inquiry with that company's designated representatives.
  • Professional advisors: auditors, attorneys, insurers, and accountants under confidentiality obligations.
  • Legal and safety: to comply with applicable law, respond to lawful requests, enforce agreements, or protect the rights, property, or safety of Elevate, our clients, or others.
  • Business transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to standard confidentiality protections.

7. International Data Transfers

We are based in the United States, and our subprocessors may operate in multiple jurisdictions. Where required, we use appropriate transfer mechanisms (such as the EU Standard Contractual Clauses) to protect personal data transferred outside your country of residence.

8. Data Retention

We retain personal information only as long as necessary for the purposes described in this Policy, including to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. Typical retention periods:

  • Prospect inquiries: up to 24 months from last contact.
  • Engagement records and deliverables: for the duration of the engagement plus the period required by applicable statutes of limitation and tax rules (generally up to 7 years).
  • Marketing preferences and opt-out records: until you withdraw consent, plus a reasonable suppression period.

9. Security

We implement administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit (TLS), access controls based on least privilege, multi-factor authentication for sensitive systems, logging and monitoring, secure software development practices, and vendor security reviews. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

Depending on where you live, you may have the right to: (a) access the personal information we hold about you; (b) request correction of inaccurate data; (c) request deletion; (d) object to or restrict certain processing; (e) request data portability; and (f) withdraw consent at any time without affecting the lawfulness of prior processing.

Residents of California (CCPA/CPRA), Virginia, Colorado, Connecticut, Utah, and other U.S. states with comprehensive privacy laws may have additional rights, including the right to opt out of "sale" or "sharing" of personal information. We do not sell personal information and do not share it for cross-context behavioral advertising.
